Refund Policy

Section 01

Overview and Scope

This Refund Policy governs the circumstances under which Klyrova Analytics will issue refunds, credits, or other remedies in connection with our IT consulting and advisory services. This Policy applies to all engagements entered into with Klyrova Analytics and should be read in conjunction with our Terms of Service.

Because Klyrova Analytics provides professional consulting services — specifically advisory, analytical, and documentation services — our refund structure reflects the nature of intellectual labor and professional engagement time. Unlike physical goods or subscription software, advisory services involve significant non-recoverable professional time allocated to each engagement.

// Advisory Services Context
Professional advisory services are inherently different from product purchases. Our output is structured analytical work and documentation. Once professional time has been applied to an engagement, that time cannot be recovered. This Policy reflects that commercial reality while maintaining fair treatment of our clients.

We approach refund requests professionally and in good faith. Our goal is not to withhold reasonable remedies, but to be transparent about the limitations inherent in professional services billing.

Section 02

Payment Terms

All payment terms applicable to a specific engagement are set forth in the applicable Scope of Work or invoice. Standard payment arrangements at Klyrova Analytics are as follows:

  • Retainer Engagements: A non-refundable retainer fee is due prior to commencement of work. This retainer covers initial scoping, intake processing, and resource allocation. The balance of fees is invoiced upon milestone completion or on a schedule specified in the Scope of Work.
  • Fixed-Scope Engagements: Fixed-price engagements are billed as described in the applicable Scope of Work, typically as a deposit plus a balance upon delivery of the final report.
  • Hourly Advisory: Hourly advisory services are billed in arrears or at intervals specified in the applicable agreement. Completed hours are non-refundable.

All invoices are due within the payment period specified on the invoice. Late payments may result in suspension of active engagements and may accrue interest at the rate of 1.5% per month or the maximum rate permitted by applicable law, whichever is lower.

Invoices are issued in United States Dollars (USD). Any applicable taxes, duties, or levies are the responsibility of the Client.

Section 03

Refund Eligibility Matrix

The following matrix summarizes refund eligibility based on engagement stage and cancellation circumstances:

Cancellation before work begins (within 48 hours of payment) Full Refund Full refund less any payment processing fees, provided no work has commenced.
Cancellation before work begins (after 48 hours) Partial Retainer fees are non-refundable. Non-retainer amounts may be refunded proportionally.
Cancellation during active engagement (Client-initiated) Partial Fees for completed work are non-refundable. Unused amounts for incomplete deliverables may be credited.
Cancellation during active engagement (Company-initiated, non-cause) Pro-Rata Pro-rata refund of fees paid for undelivered work. No additional liability.
Non-delivery of agreed deliverable Full Refund Full refund for specific undelivered deliverable. Completed deliverables are non-refundable.
Dissatisfaction with recommendations Not Eligible Disagreement with advisory content is not grounds for refund. One revision cycle is included.
Retainer fees Non-Refundable All retainer fees are non-refundable once paid, regardless of circumstances.
Force majeure events Case-by-Case Evaluated individually. Credits or extended timelines offered as appropriate.
Section 04

Non-Refundable Items

The following are explicitly non-refundable under all circumstances:

  • Retainer and Deposit Fees: All retainer and deposit payments are non-refundable once paid, as these cover resource allocation, intake processing, and opportunity costs incurred upon commencement of an engagement.
  • Completed Professional Hours: Hours already worked by our advisory team on a client engagement are non-refundable, regardless of the client's satisfaction with the output. This includes all time spent on intake processing, analysis, research, drafting, review, and communication.
  • Delivered Deliverables: Once a report, recommendation document, analysis, or any other agreed deliverable has been delivered to the Client in substantially complete form, fees associated with that deliverable are non-refundable.
  • Third-Party Costs: Any third-party costs incurred by Klyrova Analytics in connection with an engagement (e.g., licensed data, specialist subcontractors, software tools) are non-refundable.
  • Consultation Sessions: Fees for consultation or advisory sessions that have occurred are non-refundable, regardless of whether the session met the client's expectations.

Clients who are dissatisfied with the content of any deliverable are entitled to one (1) revision cycle at no additional charge. Additional revisions beyond this included cycle may be provided at Klyrova Analytics' discretion and may be subject to additional fees.

Section 05

Refund Request Process

To request a refund, clients must follow the formal process outlined below:

  1. Written Notice: Submit a written refund request to billing@klyrovaanalytics.com. The request must include: your full name and company, the applicable engagement reference number, the amount requested, and a clear description of the reason for the request.
  2. Acknowledgment: We will acknowledge receipt of your request within two (2) business days.
  3. Review Period: Klyrova Analytics will review the request and respond with a determination within ten (10) business days of acknowledgment. Complex cases may require additional time, and we will communicate any extensions.
  4. Resolution: Approved refunds will be processed within fifteen (15) business days of approval notification. Refunds will be issued via the original payment method where possible. Alternative methods may be used if the original payment method is no longer available.

Refund requests submitted more than sixty (60) days after the delivery of the final deliverable or the conclusion of the engagement will not be considered, except in cases of fraud, material misrepresentation by Klyrova Analytics, or where required by applicable law.

Section 06

Engagement Cancellation Procedures

Clients who wish to cancel an active engagement must provide written notice to projects@klyrovaanalytics.com. The following terms apply to cancellations:

Client-Initiated Cancellation:

  • All fees for work completed and deliverables delivered prior to the cancellation notice are immediately due and non-refundable.
  • Work in progress at the time of cancellation will be paused. The client may elect to receive the partial deliverable as-is, or waive delivery. Fees for in-progress work are pro-rated based on completion percentage as assessed by Klyrova Analytics.
  • Any balance paid in advance for work not yet commenced will be refunded within fifteen (15) business days of the cancellation date.
  • Retainer fees remain non-refundable regardless of the cancellation timing.

Company-Initiated Cancellation (Without Cause):

  • Klyrova Analytics may cancel an engagement without cause with fourteen (14) days written notice.
  • A pro-rata refund of fees paid for work not yet commenced will be issued within fifteen (15) business days.
  • Partial deliverables completed to date will be delivered to the client in their current state at no additional charge.

Company-Initiated Cancellation (With Cause):

  • Klyrova Analytics may immediately cancel an engagement if the client materially breaches these Terms, provides false information, fails to remit payment, or engages in conduct that makes continued engagement impractical.
  • In such cases, fees for completed work remain due. Advance payments for work not yet commenced may be refunded at Klyrova Analytics' sole discretion.
Section 07

Dispute Resolution

Klyrova Analytics is committed to resolving refund disputes professionally and in good faith. We encourage clients to contact us directly before initiating any formal dispute process.

If you believe a refund determination is incorrect, you may escalate the matter by submitting a written appeal to legal@klyrovaanalytics.com within twenty (20) business days of receiving the initial determination. Your appeal should include any additional information or context not previously provided.

Appeals will be reviewed by a senior member of the Klyrova Analytics team not involved in the initial determination. A written response will be provided within fifteen (15) business days.

If a refund dispute cannot be resolved through internal escalation, it shall be subject to the dispute resolution procedures set forth in our Terms of Service, including binding arbitration in Lexington, Kentucky.

Initiating a payment dispute or chargeback through your financial institution prior to exhausting the written dispute process described above constitutes a breach of these Terms and may result in immediate termination of all services.

Section 08

Amendments to This Policy

Klyrova Analytics reserves the right to modify this Refund Policy at any time. Changes will be effective upon posting to our website with an updated effective date. Material changes will be communicated to active clients with at least fourteen (14) days advance notice.

The version of this Policy in effect at the time of payment for a specific engagement governs refund rights for that engagement. Subsequent changes to this Policy do not retroactively affect the refund rights applicable to prior payments.
